1. Agreement to Terms

By accessing or using Srvey ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

Srvey is a survey platform for research teams that provides:

  • Survey creation with multiple question types and branching logic
  • Response collection and data storage
  • Analytics and reporting on survey responses
  • Team collaboration and role-based access control
  • Custom branding and white-labelling options
  • CSV export and data portability
  • Webhook integrations for real-time notifications

3. Account Terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must promptly notify us of any unauthorised use of your account.
  • One person or entity may maintain multiple team accounts for separate projects.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Collect personally identifiable information from respondents without proper consent or legal basis
  • Create surveys that contain illegal, harmful, or deceptive content
  • Attempt to gain unauthorised access to the Service or its infrastructure
  • Use the Service to send unsolicited communications (spam)
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or redistribute the Service without our written consent

5. Survey Data Ownership

Your survey data belongs to you:

  • You are the data controller for all survey content you create and responses you collect.
  • Srvey acts as a data processor, processing survey response data solely on your behalf and according to your instructions.
  • You may export your data at any time in standard formats (CSV).
  • We will not access, use, or share your survey response data except as necessary to provide the Service.
  • You are responsible for ensuring your surveys comply with applicable data protection laws, including obtaining appropriate consent from respondents.

6. Payment and Billing

  • Subscription fees are billed in advance on a monthly or annual basis.
  • All prices are in EUR and exclusive of VAT, unless stated otherwise.
  • We may change pricing with 30 days' notice. Existing subscriptions are honoured until renewal.
  • Refunds are handled on a case-by-case basis. Contact [email protected] for refund requests.

7. Limitation of Liability

To the maximum extent permitted by Dutch law:

  • Srvey shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
  • We are not liable for data loss caused by circumstances beyond our reasonable control.

8. Availability and Support

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. Support is available via email at [email protected].

9. Intellectual Property

The Service, including its design, code, and documentation, is owned by Srvey and protected by Dutch and international intellectual property laws. Your subscription grants you a limited, non-exclusive licence to use the Service.

10. Termination

  • You may cancel your account at any time from your account settings.
  • We may suspend or terminate your account for violation of these terms, with notice where practicable.
  • Upon termination, your data will be retained for the legally required period (see our Privacy Policy) and then deleted.
  • You may request an export of your data before account closure.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be submitted to the competent court in the Netherlands.

12. Changes to Terms

We may modify these Terms with 30 days' notice via email or the platform. Continued use after the notice period constitutes acceptance of the updated terms.
